charity property work

  • In the context of the merger of two charities, dealing with the transfer of both freehold and leasehold properties to the merged body. The freehold transfers were straight forward, but the leasehold properties proved to be very complex as we had to apply for landlord’s licence to assign in respect of each property.
  • Handling all aspects of property work for an educational trust, with the most recent being the mortgage work required to enable the school to build a new sixth form unit.
  • Dealing with a lot of different property matters for a charitable organisation that works with children and young people in and around South East Hampshire in a variety of settings, including schools, colleges and community buildings. At the moment our efforts are concentrated on dealing with leasehold property work in connection with the expansion of their nursery businesses.
  • Handling the very complex work concerning severely onerous leases taken on by a charitable trust that operates 2 multi-purpose sports and leisure centres in Hamshire. At the time of taking the leases, no independent legal advice was sought and the trustees believed that a landlord would not enforce the very severe repairing and maintenance obligations, which they subsequently have.
  • Advising a charity on disposal of land forming part of a major development area. Overage provisions and taxation consequences provided particular challenges in handling the matter.
