Corporate Manslaughter Act now live

The Corporate Manslaughter and Corporate Homicide Act 2007 came into force at the beginning of last month.

 

The well-publicised legislation sets out a new offence for convicting an organisation where a gross failure in the way activities were managed or organised results in a person’s death. This will apply to a wide range of organisations across the public and private sectors. The new offence will enable courts to look at management systems and practices across the whole of an organisation, thereby excluding the need for a 'directing mind' to be proved in order for a conviction to be made. The Act is expected to mean many companies to review and reorganise how they manage health and safety risks in the workplace.
