In November 2008 a new process was introduced by the Home Office in relation to employer sponsored work permissions, replacing the work permit regime.

The Points Based System requires employers to take out a separate registration before then being able to hire or retain employees and sets down specific responsibilities on employers and rules for ongoing compliance.

The new process requires employers to be more responsible in respect of the initial working permission, but also increases obligations on employers for monitoring their migrant workforce and reporting back to the UKBA certain changes in the terms and conditions of the employment. Illegal working legislation was also amended to reinforce these obligations.
