A company that is found to be employing migrant workers
illegally may be subject to a civil penalty of up to £10,000 per
employee and/or criminal prosecution for those that run the
business. In addition the company may be named and shamed on a
public register and even have its ability to sponsor migrant
workers withdrawn.
Illegal working legislation has been amended over the years to
place greater responsibilities on employers to check not only the
initial permission to work, but to continue to monitor that
permission.
