Introduced in 2008 the Points Based System (PBS) changed the process and ongoing compliance requirements relating to permission to work or study in the UK.

The system compromises of five tiers aimed at replacing the former routes of entry into the UK. The tiers are as follows:

  • Tier 1 is for highly skilled individuals and approval is not conditional on having a UK job offer
  • Tier 2 is for skilled workers with an offer of employment in the UK
  • Tier 3 is intended to accommodate unskilled workers for temporary cover - this tier is yet to be made operational
  • Tier 4 is for students
  • Tier 5 is for temporary workers coming to the UK.

Although the PBS was initially designed to be transparent and objective, the relevant rules and policy guidance are subject to frequent amendment. Given the lack of discretion available to Home Office staff any applicant is strongly advised to obtain professional legal assistance.
