Where an overseas business does not have a trading presence in
the UK, it can send a senior employee to the UK to establish the
business. This immigration category falls outside of the
Points Based System.
The employee will be obliged to establish a wholly owned
subsidiary or register a branch in the UK for the overseas
parent company. The application is appropriate for senior
level employees who are not majority shareholders.
The entry clearance visa application requirements include:
- a full description of the parent company's activities,
including details of assets and accounts, and
- that the employee has authority to take operational
decisions without reference to the parent company.
Extension applications are based on showing the establishment of
the business and a requirement for the employment to
continue. This category can lead to settlement in the
UK.
We can assist not only with initial entry clearance visa
applications, but also extensions or variations of stay within the
UK.
