Where an overseas business does not have a trading presence in the UK, it can send a senior employee to the UK to establish the business. This immigration category falls outside of the Points Based System.

The employee will be obliged to establish a wholly owned subsidiary or register a branch in the UK for the overseas parent company. The application is appropriate for senior level employees who are not majority shareholders.

The entry clearance visa application requirements include:

  • a full description of the parent company's activities, including details of assets and accounts, and 
  • that the employee has authority to take operational decisions without reference to the parent company.

Extension applications are based on showing the establishment of the business and a requirement for the employment to continue. This category can lead to settlement in the UK.
