Workplace mediation is a real alternative to litigation for
employees and employers and is suggested by the Advisory,
Conciliation and Arbitration Service (ACAS) where has is proven
difficult to resolve disciplinary or grievance issues
internally.
Issues in the workplace can have a lasting, emotional effect on
those involved and it can become increasingly difficult to deal
with matters face to face, and to maintain an efficient workplace
where issues remain unresolved. The mediation process recognises
the tensions involved and seeks to reach a workable solution for
all parties. Workplace mediation can also be used where a dispute
has been escalated to proceedings and can provide a mechanism for
early resolution of those proceedings. It can be particularly
useful in complex claims which may overlap into other
jurisdictions, or where the parties may wish to explain their
position more fully or seek a novel solution.
Mediation is also particularly suitable to circumstances where
the employment relationship is ongoing.
