  • Equalisation - how does the Foster Wheeler case help pension schemes? July 2009
The long awaited decision of the Court of Appeal in the Foster Wheeler equalisation case has finally arrived - and it contained something nobody had predicted or expected. The question remains, however - what does it mean for other schemes, and has it addressed some of the key questions that still remain unresolved more than 19 years after the original Barber v GRE judgment?
  • Equalisation: the explosion of the ticking time bomb Apr 2009
Judgment in Foster Wheeler Limited v Hanley and Others given on 28 November 2008 could be the final nail in the coffin for a number of UK defined benefit pension schemes. The effect is that some schemes are, or potentially are, more 'equal' than others. The additional liabilities created will add millions to pension deficits which are already crippling employers sponsoring defined benefit schemes.
