Judgment in Foster Wheeler Limited v Hanley and Others
given on 28 November 2008 could be the final nail in the coffin for
a number of UK defined benefit pension schemes. The effect is that
some schemes are, or potentially are, more 'equal' than others. The
additional liabilities created will add millions to pension
deficits which are already crippling employers sponsoring defined
benefit schemes.
