The Proceeds of Crime team have represented receivers in a
number of recently reported cases including:
- Capewell v HMRC [2007] UKHL 2, which went to the House
of Lords on the issue of whether the court has discretion to decide
who has to pay a receiver's costs under CPR 69.7
- Briggs-Price v RCPO and Nicholas O'Reilly [2007] EWCA
Civ 568 in the Court of Appeal on the issue of the defandant's
entitlement to payment of his legal costs to fund an appeal against
the making of a confiscation order
- S v S [2008] EWHC 1925 in the Administrative Court and
Family Division on the question of whether the defendant's wife's
claim for ancillary relief should be settled before the
confiscation order is satisfied.
