Blake Lapthorn Tarlo Lyons reports that the
parents of Ciaran Kiely, who was born at the Luton & Dunstable
Hospital on 3 October 1987, have issued a writ for compensation
following negligence at the hospital.
Ciaran suffers from severe cerebral palsy
affecting all four limbs, such that he is unable to sit or stand
unaided and cannot walk. The function of both of his hands is
severely impaired but he can type slowly using one finger.
Ciaran's parents have cared for him lovingly
over the years and he has made considerable progress.
However, he is completely dependant upon carers for preparation of
food and drink, though he can feed himself slowly, with difficulty,
using specialist cutlery and equipment.
Ciaran cannot dress, undress or bathe
himself. He requires a hoist to assist him to get in and out
of bed. His speech is difficult to understand, he will never
be able to live independently and will require assistance with most
activities of daily living during his entire life.
Ciaran has no prospect of obtaining
independently remunerated employment.
Since he has a good life-expectancy, Ciaran's
parents are concerned as to who will care for him when they are no
longer able to do so, and they have issued proceedings in the High
Court with a view to providing the care and equipment that Ciaran
will need throughout his lifetime.

case is completed.
