excellent result for clinical negligence
team

BC was born at Chase Farm Hospital on 5 May 1995. Due to
negligent delay at the time of her birth she suffered from brain
damage which manifested itself as cerebral palsy and learning
difficulties. She has been cared for by her family at home.
Following a letter of claim, liability was admitted by the
Hospital and Judgment was entered for BC on 6 October 2005. A trial
date was set for 15 January 2007 to determine the value of the
claim and an interim payment was obtained to provide immediate care
and much needed equipment for BC.
The value of the claim was disputed until shortly before trial
when BC agreed to accept over £3 million in the form of a lump sum
and annual payments to provide care for the rest of her life. This
award was approved by the court on 15 January 2007.

in clinical negligence (and particularly in cases involving
cerebral palsy) represented BC throughout the case and was ably
assisted by Joanne Carver.

BC suffered. Originally, the hospital were offering less than £1
million in settlement. BC and her family, and of course the firm,
