Pre-nuptial agreements should be considered if you are contemplating marriage and wish to protect your future financial position. You can enter into a pre-marital (prenuptial) agreement to ensure this. A prenuptial agreement is particularly useful when there is a business involved, inherited assets or when the interests of children from previous relationships need to be protected.

These pre-nuptial agreements are not yet legally binding in England and Wales but are evidence of intent, and weight may be placed upon them by the court if the marriage later fails.

A pre-nuptial agreement must be entered into well in advance of a wedding and both individuals must have had the opportunity to obtain independent legal advice.  Financial disclosure is essential.
