The costs risk of refusing alternative dispute
resolution
The principle that the loser pays the winner’s reasonable costs
is being increasingly eroded as the courts penalise the winning
party for failing to engage in alternative dispute resolution
(ADR). The courts are prepared to penalise an unreasonable
failure to engage in ADR, even where
other rules governing costs and settlement can be used to produce
an alternative result.
