The court will either impose penalty points or a disqualification. The court will also fine you. If the court does not disqualify you it will impose three to nine penalty points.  The maximum fine is £5,000.

To decide your penalty the Magistrates' Court will look at the degree of harm caused by the careless driving in question.

low level responsibility (momentary lapse of concentration)

You could receive the following penalties:

  • fine: 50% weekly take home pay up to the maximum of £5,000 
  • penalty points: three to four points (or possible disqualification)

high level responsibility (loss of control due to speed, mishandling or insufficient attention to road conditions)

You could receive the following penalty:

  • fine: 100% weekly take home pay up to maximum of £5,000 
  • penalty points: seven to six points (or possible disqualification)

For more serious offences such as where there has been an overtaking manoeuvre resulting in a collision and the driving is bordering on the dangerous, the penalties will be as follows:

  • maximum fine: fine of 150% of weekly take home pay up to £5,000
  • penalty points: seven to nine points or disqualifiction
