Compensation is split into two types - compensation for the pain and suffering - these are called general damages, and compensation to reimburse client's for any expenses incurred as a result of the accident - these are called special damages and include items such as, medical fees, prescription charges, ruined clothing or care given by relatives.

 

Typical awards for pain and suffering (general damage) include:

  • whiplash - between £750 and £4,250 depending on the length of the recovery period.  Injuries at the bottom end of this range generally completely resolve within a few weeks, injuries at the top end take up to two years to resolve
  • broken leg - awards can reflect a wide range of injuries, ranging from complicated fractures requiring bone grafts or extensive surgery and which leave a permanent disability, to a simple fracture from which there has been a complete recovery.  Awards range from £5,000 to £74,000
  • broken wrist - where there is full recovery within a few months awards are likely to be around £4,000, with simple soft tissue injuries receiving less.  Severe wrist injuries which result in permanent and serious disability are likely to receive around £30,000
  • broken hip - straightforward fractures where full recovery is anticipated attract awards of about £4,000. Awards will be higher, in the region of £20,000 where the fracture is complicated or permanently disabilities result from the accident
  • fractured skull - awards are likely to be between £1,250 and £7,000, depending on the severity of the injury, the time taken to recover and any residual problems.  Where brain damage has resulted from the fracture awards will be significantly higher
