It's that time of year when there can be snow and ice on our
roads and pavements. Unfortunately it is therefore quite common for
people to slip and fall. If you are injured in such a way it may be
possible to make a claim against the local authority or council for
failure to grit and maintain the area. There is a duty on councils
and occupiers to grit roads when they are aware there is going to
be bad weather, which will result in a snow or ice covering.
Equally if you slip, fall and hurt yourself at work under
Regulation 12 of the Management of Health and Safety at Work
Regulations employers are required to ensure that the 'surface
of every traffic route in the workplace' is suitable for the
purpose for which it is used and their surfaces are not slippery or
have no substance on them that exposes employees to a risk of
slipping. Therefore if an employee slips on snow or ice as a
failure by the employer to grit then they may have a claim for
compensation.
