asbestos exposure - case study

Our clients were the son and daughter of a former Ministry of
Defence (MOD) employee. Their late father had numerous health
issues and it was discovered, at an inquest following his death,
that he also had mesothelioma, a cancer caused by asbestos
exposure. The deceased had not been aware of his illness as it had
not been diagnosed and he did not leave a widow. The claim was
brought on behalf of his Estate for the benefit of his
beneficiaries.
The deceased, although having worked for the MOD, had also
worked for heating installation companies and the Merchant Navy.
There were therefore periods of employment where he could have been
exposed to asbestos other than during his time with the MOD.
However, because in all probability he was exposed to asbestos
during his MOD employment, we were able to recover the claim in
full.
outcome: Our client settled out of court for
£45,000.
