no win, no fee

If you enter into a ‘no win no fee’ agreement, there is no cost to you in perusing the claim, win or lose.

If you have been injured on an aircraft, or in the course of boarding or disembarking, you may have a claim. The ‘injury’ may have been caused by an accident that was not your fault, or an illness contracted whilst travelling.

Blake Lapthorn has many years of experience in dealing with claims against airlines. As well as having a large team of specialist lawyers in the UK who are dedicated to travel and holiday claims, we also have a network of foreign agents that we can call upon for overseas expertise.

what types of injury can I claim for?

Examples of the kinds of accidents or illnesses you can claim for against an airline include:

  • an air crash
  • collision on the runway
  • spilling of hot food or drink
  • food poisoning from airline catering
  • tripping over a hazard
  • falling items from overhead lockers

In certain cases there may be no need to prove fault or negligence on the part of the airline concerned.

where will the claim be made?

Under the Montreal Convention, a claim can be brought in the country where the airline is based, the country where you were flying to, or the country where you live if the airline also conducts its business there.

Our knowledge will work to your advantage. We will consider with you all the possible locations for making a claim, bearing in mind the potential amount of compensation obtainable in each location, and the legal costs involved.

how quickly should I claim?

Contact us as soon as possible after the incident, taking advantage of our free initial consultation. The time limit for bringing a claim for an air accident is generally two years from the date of the accident, but time limits can vary.

funding your claim – the best option for you

We will discuss all funding options with you, most personal injury claims can be persued at no cost to you. You may have legal expenses insurance on your travel insurance, house insurance, or on your car insurance. Trade union membership sometimes includes legal expenses insurance. Alternatively, your claim may be eligible for our ‘no win no fee’ arrangement.
